A legal disclaimer

The explanations and information provided on this page are Terms of Use (also referred to as ‘Terms’ or ‘Terms  and Conditions’ or ‘T&C’ or ‘T&Cs’) set by Paidlancers (‘we’, ‘us’ ‘Paidlancers.com’, this website, that’s been  created for the use of the visitors (browsers, clients and professionals and so on). The terms and conditions  outlined on this website are a set of legally binding terms to be accepted by all visiting parties before any  participation occurs. The T&Cs set forth are the legal boundaries that govern the activities, exchanges and  engagements between site visitors for the period during and after until any transaction or exchange resulting  directly as a result of Paidlancers.com are fully completed. The terms are also used as a guideline during  exchange between visitors and the Paidlancers team. Any complaints will be dealt with in accordance with  terms. The terms set out on this website will also apply to any other product (e.g., apps or sister websites,  printed materials, submissions, hiring process, merchandise and other affiliates) produced and/or operated by  Paidlancers, including its social media channels and all video upload and blog and forum pages).

Any visitor submitting their details (request or portfolio) is required to be at least 18 years of age.

1 Terminology on the website:

1.1 Paidlancers.com – Website created and published by Paidlancers. This website helps in connecting a Client  to a Professional registered on the website. (Clause 2.1)
1.2 Client (also known as a ‘Customer’) – is a visitor who engages with the site to book a Freelancer (also called  a ‘Creative’ or a ‘Professional’ or ‘Freelance Creative’ or ‘Creative Freelancer’ or a “Paidlancer” or a “Pro”)  (Clause 2.2)
1.3 Professional (or a Pro)- is a visitor who engages with the site to add their portfolio to showcase it for  public/visitors. (Clause 2.3)
1.4 Contract – a mutual agreement between client and freelancer to fulfil a service transaction. (refer to Clause  2.4)
1.5 Connection – service provided by Paidlancers to connect a client with the freelancer (Clause 2.5)
1.6 Request – submitted by the client through the ‘Client Form’ to get connected by a professional. (Clause 2.6)
1.7 Job/Work – ‘Service’ required by the client for which they will submit request.

2 Service Clause:

2.1 This website is created to help clients search for a creative professional by submitting a request.
2.2 Client enters their details (name, location, email, category professionals/skill required) date of event, detail  of the job) on the ‘Client Form’ and submits the form to start receiving responses from freelance professionals.
2.3 A Professional/Freelancer is the one who has uploaded their portfolio through ‘Professional’s Submission Form’ on the  website and has agreed to receive requests from clients seeking professionals for freelance work/job.
2.4 A contract is usually (highly recommended) signed by both parties as a commitment to fulfil the transaction.  The contract means that the client will pay the agreed amount (as per the contract) to the freelancer in return for  the service provided by the freelancer.
2.5 Paidlancers will act as a medium to connect the client with the freelancer through means of algorithmically  matching the client’s request to professionals in the location specified by the client. This can be online/remote.
2.6 This service is available to the professional for a fee*.

3 What will you, as a Professional/Freelancer, do?

3.1 Review the request before committing to the client and entering into a contract with the client.
3.2 Mutually agree upon a fee with the client, based on the job or service that they are hiring you for, before  signing a contract.
3.3 Make sure you discuss the logistics and professional workspace with the client to confirm a safe working  environment for yourself.
3.4 Keep work-life balance in mind when working.
3.5 Honour the contract that you and the client have mutually agreed upon.
3.6 Treat every client reaching out to you with utmost respect.

4 Paidlancers role for a Professional:

4.1 Our role is to receive your submission, review it, and based on the content, either upload on our website, or  reject (if content does not comply with our content policy Clause 8.1 to 8.5) it.
4.2 Submissions uploaded on the website can be retained for a minimum of 6 months in case of free  uploads)receive request from you, the client, and forward it to the professionals who have their portfolios posted  on our website.
4.3 We are the medium to connect you to the professionals so their work/portfolios can be shared with you.
4.4 We share the information that you provide only with the relevant professionals so they can contact you about  your request.

5 What Paidlancers will not do:

5.1 We do not share your information with any party that is not associated with our website.
5.2 Other than sharing your information with the professionals, we do not participate in any other form of  communication between you and the professional.
5.3 We are not responsible for any content posted on professional’s website or portfolio, and cannot in any way  influence their decision to post the content and, for this reason, it is your responsibility to confirm the  information by communicating with the professional.
5.4 We do not negotiate with any party on your behalf. Our responsibility ends once introductory connection is  established between you and the professional through our website.
5.5 We not act on any party’s behalf to resolve any issues arising due to any failures in the service. This should  be resolved directly between the parties.

6 Liability:

6.1 Paidlancers is not liable for any form of loss or damage of service/business/revenue/property occurring as a  result of transaction between the parties.
6.2 Clients and professionals are liable to each other to compensate for any losses/damage as mentioned in  Clause 6.1.

7 Changes:

7.1 Our Terms and Conditions are regularly updated/amended. All visitors are expected to read the terms before  accepting.
7.2 If a new party acquires our business while the website visitors are registered with us, then the contract is  automatically transferred to the new owner who will have every right to exercise freedom to change these terms  as they deem fit.
7.3 Change of ownership notification will be sent to all registered members, and the members can then decide  whether or not to continue with the membership.
7.4 Members are advised to keep checking the T&Cs to stay updated of the terms.

8 Content Policy:

8.1 Any content posted on Paidlancers.com should be the original copyrighted work of the professional.
8.2 If plagiarism is detected or reported, then the content will be immediately taken down from Paidlancers.com website until it is proven otherwise by the professional themselves.
8.3 Content should not contain any biased, judgemental or offensive remarks.
8.4 Content should not in any way contain any foul, racist or sexist language.
8.5 Profanity and/or nudity is strictly prohibited in the uploaded content (image, text, video, links, etc.). Such  content will not be approved by the Paidlancers team, or will be removed and user deactivated without  explanation and/or refunds as soon as such a content is brought to our attention.
8.6 External links posted by professionals should also abide by the content policies (Clause 8.1 to 8.5). We do  inspect the listings from time to time, and any content in breach of the conditions/policies laid out in our terms  will be immediately taken down from Paidlancers.com website.

9 Submitting work:

9.1 Submitting your work is completely free.
9.2 The work is reviewed and listed on Paidlancers.com by our team at no charge to you, the professional.
9.3 Because of very high quality of work we select to list on our website, the professionals can proudly share the  link to their page on social media channels or other platforms as they deem fit.
9.4 Professionals only need to buy credits if and only if they wish to contact a client.
9.5 The cost of credits can be found on credits page.
9.6 Credits can be purchased in advance when they become available on the website. 

9.7 Credits are non-refundable and non-transferable.
9.8 Subscription to get published on high-visibility Featured Page and instant-visibility Home Page’s Star  Professionals section can be purchased. The professionals subscribed to Home Page’s Star Professionals section will have their portfolio visible to client as soon as the client comes to the website. Professionals on Featured  Page have a high chance of being contacted by the Clients due to visibility soon after submission of request.

10 Guarantee:

10.1 Paidlancers is a platform to connect the Professionals with the Clients. It offers no guarantee beyond that service, but suggests that a Professional should only send proposals for jobs they are happy to proceed with if accepted. It is upto the Client to decide if they want to proceed with the proposal. It is highly recommended that professionals add their website address, email address and telephone number for the Clients directly when sending proposals, so the Client can check Professional’s portfolio and contact them directly. Paidlancers does not get invoved with the communication between the Client and the Professional. A Professional can continue to get hired by the same Client in the future without involving Paidancers, if so they wish. We charge no further fee beyond introduction.
