A legal disclaimer

 

The explanations and information provided on this page are Terms of Use (also referred to as ‘Terms’ or ‘Terms and Conditions’ or ‘T&C’ or ‘T&Cs’) set by Paidlancers (‘we’, ‘us’ ‘Paidlancers.com’, this website), that’s been created for the use of the visitors (browsers, clients and freelancers and so on). The terms and conditions outlined on this website are a set of legally binding terms to be accepted by all visiting parties before any participation occurs. The T&Cs set forth are the legal boundaries that govern the activities, exchanges and engagements between site visitors for the period during and after until any transaction or exchange resulting directly as a result of Paidlancers.com are fully completed. The terms are also used as a guideline during exchange between visitors and the Paidlancers team. Any complaints will be dealt with in accordance with terms. The terms set out on this website will also apply to any other product (e.g., apps or sister websites, printed materials, submissions, hiring process, merchandise and other affiliates) produced and/or operated by Paidlancers, including its social media channels and all video upload and blog and forum pages.

Any visitor submitting their details, request or portfolio is required to be at least 18 years of age.

 

1 Terminology on the website:

1.1 Paidlancers.com – Website created and published by Paidlancers. This website helps in Connecting Client to a Professional registered on the website. (Clause 2.1)
1.2 Client (also known as a ‘Customer’) – is a visitor who engages with the site to book a Professional (also called a ‘Creative’ or a ‘Freelancer’ or ‘Freelance Creative’ or ‘Creative Freelancer’ or “Paidlancer” or “Pro”) (Clause 2.2)
1.3 Creative (‘Freelancer’ or ‘Professional’) – is a visitor who engages with the site to add their portfolio to showcase it for public/visitors. (Clause 2.3)
1.4 Contract – a mutual agreement between a client and a professional to fulfil a service transaction. (Clause 2.4)
1.5 Connection – service provided by Paidlancers to connect a client with a professional. (Clause 2.5)
1.6 Request – submitted by the client through the ‘Client Form’ to get connected by a professional. (Clause 2.6)
1.7 Job/Work – ‘Service’ required by the client for which they will submit a request.

 

2 Service Clause:

2.1 This website is created to help clients search for a creative professional by submitting a request.
2.2 Client enters their details (name, location, email, category professionals/skill required) date of event, detail  of the job) on the ‘Client Form’ and submits the form to start receiving responses from freelance professionals.
2.3 A Professional is the one who has uploaded their portfolio through ‘Professional’s Submission Form’ on the  website and has agreed to receive requests from clients seeking professionals for freelance work/job.
2.4 A contract is usually (highly recommended) signed by both parties as a commitment to fulfil/honour the  transaction. The contract means that the client will pay the agreed amount (as per the contract) to the  professional in return for the service provided by the professional.
2.5 Paidlancers will act as a medium to connect the client with the professional through means of  algorithmically matching the client’s request to professionals in the location specified by the client. This can be  online/remote.
2.6 This service is available to the client for free.

 

3 What will you, as a Client, do?

3.1 Review the work of the professionals before hiring and entering a contract with the professional.
3.2 Agree to suitably pay the professional, based on the job or service that you hired them for.
3.3 Make sure the working space and location of work is completely safe for the professional to work in.
3.4 Keep work-life balance in mind when hiring a professional.
3.5 Honour the contract that you and the professional have mutually agreed upon.
3.6 Treat every professional reaching out to you with utmost respect.

 

4 Paidlancers role for the Client:

4.1 Our role is to receive request from you, the client, and forward it to the professionals who have their  portfolios posted on our website.
4.2 We are the medium to connect you to the professionals so their work/portfolios can be shared with you.
4.3 We share the information that you provide only with the relevant professionals so they can contact you about  your request.
4.4 We reserve the right to deactivate any account that has breached the terms, used disrespectful, profane or  rude language when engaging with a professional or any member of our team if such an incident is reported and  our investigation confirms an untoward behaviour.

 

5 What Paidlancers will not do:

5.1 We do not share your information with any party that is not associated with our website.
5.2 Other than sharing your information with the professionals, we do not participate in any other form of  communication between you and the professional.
5.3 We are not responsible for any content posted on professional’s website or portfolio, and cannot in any way  influence their decision to post the content and, for this reason, it is your responsibility to confirm the  information by communicating with the professional.
5.4 We do not negotiate with any party on your behalf. Our responsibility ends once introductory connection is  established between you and the professional through our website.
5.5 We not act on any party’s behalf to resolve any issues arising due to any failures in the service. This should  be resolved directly between the parties.

 

6 Liability:

6.1 Paidlancers is not liable for any form of loss or damage of service / business / revenue / property occurring  as a result of transaction between the parties.
6.2 Clients and professionals are liable to each other to compensate for any losses/damage as mentioned in  Clause 6.1.

 

7 Changes:

7.1 Our Terms and Conditions are regularly updated/amended. All visitors are expected to read the terms before  accepting.
7.2 If a new party acquires our business while the website visitors are registered with us, then the contract is  automatically transferred to the new owner who will have every right to exercise freedom to change these terms  as they deem fit.
7.3 Change of ownership notification will be sent to all registered members, and the members can then decide  whether or not to continue with the membership.
7.4 Members are advised to keep checking the T&Cs to stay updated of the terms.
